I noticed that too! Their "spelling bee" logo is the exact same font/type as the Broadway production marketing. Very interesting. I was expecting the children to sing and dance after their coughs were gone!
I too thought it was a Spelling Bee commercial when I first saw it. I think the producers should sue. Delsym uses the exact same font and even has a bee in the corner of the sign.
CATSNY why do you think the producers should sue? Spelling Bee certainly hasn't been damaged by the commercial in anyway. If anything it has reminded people about the show. This is not something worth suing over.
I hope you're joking. Incase you are serious though, prove your point in a court of law. Prove to a jury or judge that that commercial put that thought in the heads of potential ticket buyers.
Whether it's damaging or not, they could still potentially sue for copyright stuff, assuming they've trademarked the design. People do it all the time, it's silly most of the time, like Metallica suing a furniture store with the same name, but it's been known to happen.
That being said, I completely thought of Spelling Bee when I saw the commercial, but the producers probably have better things to worry about.

Clearly many people in this thread who saw the commercial assumed for a moment that it was a commercial for the show, so it probably isn't a stretch for Spelling Bee to assume other people would confuse the commercial with a commercial for the show. They could claim that Delsym is profiting through additional sales by using copyrighted designs and trademarks from the show without permission.
I definitely had a "whoa" moment when I first saw it. Unfortunately I was with people who would neither know what I was talking about nor care, so I had to keep it to myself.
The most upsetting thing is that the commercial is too short for me to look at each of the children and go "that one is Marcy Parks"
